Your rights and responsibilities when using PetBG Journal

About These Terms

These Terms of Service explain the rules for using the PetBG Journal mobile application (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

PetBG Journal is developed and operated by Phil​ipp She​sta​kov (“we”, “us”, or “our”).

Your license to use the App is governed by the license terms presented through the App Store. If no custom license is presented, Apple’s Standard End User License Agreement applies. These Terms govern the services and features we provide within the App. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.

What PetBG Journal Does

PetBG Journal helps people caring for diabetic cats and dogs keep an organized history of their pet’s care. Depending on the features available to you, the App can help you:

  • Record glucose readings, insulin and medication entries, weight, and notes
  • Review changes and patterns over time
  • Create reports from the information you have entered
  • Share a pet profile with a partner, family member, or trusted friend in your Care Team
  • Use the same signed-in profile across supported devices

You can use guest mode without creating an account. Information entered in guest mode remains associated with that installation of the App. If you sign in, your information can be synchronized across supported devices and shared with people you invite.

The Privacy Policy explains how information is handled in guest mode and when you sign in.

Veterinary Care and Safety

PetBG Journal is intended for record-keeping and visualization. It is not intended to diagnose your pet, recommend treatment or insulin doses, or control a glucose meter or insulin delivery device. It does not replace professional veterinary care.

Glucose categories, charts, summaries, reminders, and reports are based on the information and ranges entered in the App. They are not a clinical assessment. Always follow the guidance of your veterinarian when making decisions about insulin, medication, food, or any other part of your pet’s treatment.

If you believe your pet may be experiencing an emergency, contact a veterinarian or emergency veterinary service immediately. Do not delay care because of information displayed in the App.

You are responsible for checking that readings, doses, times, notes, and glucose ranges are entered correctly. If something shown in the App appears unexpected or incorrect, verify the original measurement and speak with your veterinarian before acting on it.

Accounts and Shared Care

You are responsible for protecting access to your device and account. Use the security features available on your device and do not share account credentials.

When you send a sharing link, the person who accepts it may be able to view and add information to the shared pet profile. Only invite people you trust and who are involved in caring for that pet. Each Care Team member is responsible for the accuracy of the information they add.

You may not access, use, or share another person’s account or pet profile without permission.

Free and Premium Features

Core logging features and sharing with one additional Care Team member are available without a paid subscription. A larger Care Team and other optional Premium features require a monthly or annual subscription. The current features, price, billing period, and any trial terms are shown in the App before you confirm a purchase.

We may add, improve, or reorganize features over time. Changes to a digital service remain subject to the protections described under “Availability and Changes to the App” below and to applicable consumer law.

Subscriptions, Cancellation, and Refunds

Premium subscriptions are purchased and managed through the App Store. Apple processes the payment, provides the purchase confirmation, and charges the payment method associated with your Apple Account.

Subscriptions renew automatically for the billing period shown at purchase unless you cancel before the end of the current period. You can manage or cancel a subscription through your Apple Account:

  1. Open Settings on your device
  2. Tap your name
  3. Tap Subscriptions
  4. Select PetBG Journal

Deleting the App does not cancel a subscription. After cancellation, Premium access normally continues until the end of the paid billing period.

Refund requests for App Store purchases are handled by Apple. You can submit a request at reportaproblem.apple.com. Eligibility depends on Apple’s terms and the laws that apply where you live. Your mandatory consumer rights remain unaffected.

Information You Add

We do not claim ownership of the glucose readings, medication entries, notes, or other information you add to the App.

You give us the limited rights needed to store, synchronize, display, export, and share that information as directed by you and as necessary to operate the App. These rights are non-exclusive and end when the information is deleted, except where temporary retention is technically necessary or the law requires otherwise. The Privacy Policy provides more detail.

You must have the right to add and share any information you enter, including information added to a shared pet profile.

Our App and Intellectual Property

The App, including its software, design, graphics, branding, and original content, belongs to Phil​ipp She​sta​kov or the relevant licensors. The App is licensed, not sold.

Your license to use the App is personal, limited, non-exclusive, non-transferable, and subject to these Terms, the license terms presented through the App Store, and applicable App Store usage rules.

Except where applicable law expressly permits it, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or attempt to extract the source code of the App.

Acceptable Use

You agree not to:

  • Use the App for an unlawful purpose
  • Interfere with the App’s security, operation, or availability
  • Attempt to bypass subscription, access, or security controls
  • Use automated tools to scrape or overload the App or its services
  • Upload malicious code or content that infringes another person’s rights
  • Misrepresent your identity or your permission to access a shared pet profile

Availability and Changes to the App

We work to keep the App available and functioning as intended, but temporary interruptions may occur because of maintenance, updates, security work, or events outside our reasonable control. Some features require a supported device, a compatible operating system, and an internet connection.

We may update the App for valid reasons, including improving functionality, maintaining security, meeting legal or regulatory requirements, or adapting to technical changes. We will not charge you an additional fee solely because of such an update.

If a change materially reduces your ability to access or use a continuously provided digital service, we will provide clear advance notice where required by law. That notice will explain the change, when it takes effect, and any right you have to end the affected service without charge.

Suspension and Ending Use

You may stop using the App at any time. If you have a Premium subscription, you must cancel it separately through your Apple Account to prevent future renewal.

We may restrict or suspend access where reasonably necessary to address a material or repeated breach of these Terms, protect the App or other users, respond to a security risk, or comply with law. Where appropriate, we will explain the reason and give you a reasonable opportunity to correct the issue. Immediate action may be necessary in urgent, unlawful, fraudulent, or security-sensitive situations.

When use of the App ends, the handling of information associated with your account is governed by the Privacy Policy and applicable law.

Warranties and Liability

Your statutory rights concerning digital products and services remain unaffected.

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body, or health, and in any other case where liability cannot be limited by law.

For slight negligence, we are liable only where we breach an essential contractual obligation whose performance makes proper use of the App possible and on which you can reasonably rely. In that case, liability is limited to damage that was typical and reasonably foreseeable when you agreed to these Terms.

In all other cases, our liability is excluded to the extent permitted by law.

The App depends on the information you enter and is not a substitute for veterinary judgment. The veterinary-care responsibilities described above remain yours, but nothing in these Terms excludes liability where applicable law provides otherwise.

Changes to These Terms

We may update these Terms for valid reasons, such as changes to the App, security needs, legal requirements, or clearer wording.

The current version and its “Last Updated” date will always be available on this page. If a change materially affects your rights or obligations, we will provide reasonable advance notice in the App or through another durable form of communication where required by law. We will ask for your agreement when applicable law requires it.

Changes do not apply retroactively unless the law permits or requires this. If you do not agree to an updated version, you may stop using the App and cancel any active subscription. Your mandatory rights remain unaffected.

Governing Law and Disputes

German law applies to these Terms. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you usually live.

Courts have jurisdiction as determined by applicable law. If you are a consumer in the European Union, you may generally bring a claim in the courts where you live. We will not require you to use arbitration or mediation before bringing a claim.
